Samsung is attempting to have the recent $ 1 billion patent verdict in favor of Apple thrown out, on the basis that the foreman of the jury was biased.
But foreman Velvin Hogan, says Samsung, failed to disclose both a personal bankruptcy filing from 1993 and a twenty-year-old lawsuit from his former employer, hard drive manufacturer Seagate Technology.
And because Samsung has a 'substantial strategic partnership' with Seagate, it says, Hogan should have revealed the lawsuit. A further source of bias, it says, is the fact that the Seagate lawyer who filed the complaint against Hogan at the time is married to an attorney from the firm that represented Samsung during the Apple patent trial.
But in an interview with Bloomberg, Hogan says he was only asked to disclose any lawsuits that had take place in the last ten years.
"Had I been asked an open-ended question with no time constraint, of course I would’ve disclosed that," he said. "I answered every question the judge asked me."
Hogan is even speculating that, because of the relationship between the two lawyers, Samsung knew all about the Seagate lawsuit from the start - and allowed him on to the jury precisely so that it would have grounds for this appeal later on.
The allegations will be heard in December.

Question by Typical California Liberal: Are "closed shop" businesses and governments unconstitutional? Basically, a closed shop is one where you have no choice but to join the union in order to work in a certain place. Taft-Hartly outlawed Closed Shop in 1947, BUT allowed "Union Shop". Now you can't be "forced" to join the union, but you can be forced to pay dues to the union in certain states without being a member. Or, an equal amount to the union dues must be deducted from your check. Or in some states, you have to eventually join the union..or lose your job. Is this in effect the same as closed shop? Businesses are free to be closed shop or not, but the govt should NEVER force someone to join a private organization before being qualified to be employed.

My employees would all walk out if I ever entertained the idea of letting a Union Organizer come in and even talk to them! They are all ex union members and we have had it brought up in employees meetings with all saying not to even think about it! They are very happy with wages I pay them and having fully paid benefits for them and their families! We're a closed shop TO the unions!

If it wasn't legal the courts would have said so by now. If you get the benefits of union representation, it is fair that you pay for them.

If a business requires you to join a union in order to work there that is legal in my opinion, but for workers to force any one to join and force them to pay dues does not protect their liberty and as such the government should protect them because it is their voluntary duty. The politicians took an oath to protect every persons liberty as the main function and purpose of government.

The OWNER has a right to "close" his shop. Where States allow an outside agency to COMPEL a shop to "close" this is a clear and obvious violation of human rights - which ALL Democrats demand be universal.
